An Alabama inmate has filed a lawsuit against the state to avoid being the second person to be executed by nitrogen gas. Lawyers for Alan Eugene Miller, 57, have cited the first instance of death by nitrogen gas in their case to claim the method is a cruel and unusual punishment. Kenneth Smith was left shaking and convulsing on a gurney as he was put to death by nitrogen gas in January
